SAN BERNARDINO, Calif. – The San Bernardino County District Attorney’s Office has completed its review of the officer-involved shooting of 20-year-old Ray Blajos of Hesperia by San Bernardino County Sheriff’s Deputy Michael Cleary on Dec. 19, 2010.
Under the facts, circumstances, and applicable law in this matter, Deputy Cleary’s fear of death or great bodily injury was reasonable based on the totality of the circumstances. The immediate use of deadly force was necessary to defend against the danger.
Therefore, the shooting was justifiable in self-defense and the defense of others and no criminal liability attaches to the conduct of Deputy Michael Cleary.
