SAN BERNARDINO, Calif. – The San Bernardino County District Attorney’s Office has completed its review of the non-fatal officer-involved shooting of Fernando Brian Chavira, 20, of Fontana, by Fontana Police Officer Edward Stewart on January 13, 2011.
The District Attorney’s Office stated that it is clear from the facts and circumstances that the risk which was presented to Officer Stewart was both imminent and deadly. It was entirely reasonable for Officer Stewart to discharge his weapon at the threatening figure who was approaching him for no ascertainable reason while wielding a knife. Therefore, the actions of Officer Stewart were legally justified.
