SAN BERNARDINO, Calif. – The San Bernardino County District Attorney’s Office has completed its review of the non-fatal officer-involved shooting of Robert Marquez, 27, of Hesperia, by San Bernardino County Sheriff’s Deputies Jeffrey Farrar, Lisa Guerra, Bela Lukacs, Gerardo Moreno, and Jeremy Vasquez on October 6, 2011.
The District Attorney’s Office stated that the deputies did not fire their weapons until Marquez had exhibited unwillingness to comply with commands, and had in fact fired one round toward the deputies. This act clearly represented an imminent threat of serious bodily injury or death to the deputies and others.
Therefore, the shooting by Deputies Jeffery Farrar, Lisa Guerra, Bela Lukacs, Jeremy Vasquez , and Gerardo Moreno, was justified in self-defense and in defense of others, and no criminal liability results therefrom.
