SAN BERNARDINO, Calif.  – The San Bernardino County District Attorney’s Office has completed its review of the fatal officer-involved shooting of Kenneth Paul Muñoz Jr., 32, of Yucaipa, by San Bernardino County Sheriff’s Sergeant Michael O’Brien, Deputies Ismael Diaz, Joseph Perea and Larry Scott, and Reserve Deputy Dan Lynch on October 26, 2011.

Under the facts, circumstances and the applicable law, the use of deadly force by Deputy Diaz and Sergeant O’Brien was legally in response to an apparent and immediate threat of death or great bodily injury to his person and therefore justified.
