Fontana man sentenced to prison for child sexual assault

SAN BERNARDINO, Calif.– A Fontana man who sexually assaulted a 10-year-old girl at a wedding was sentenced to 33 years-to-life in state prison Wednesday.

Last month a Rancho Cucamonga jury found 51-year-old Diego Martinez guilty of one count of Sexual Intercourse or Sodomy with a Child 10 Years Old or Younger and two counts of Forcible Lewd Act Upon a Child. The jury also found true on all allegations.

Martinez will also be required to register as a sex offender for the remainder of his life.

In 2010, Martinez was an uninvited guest at the victim’s parent’s wedding.

According to Deputy District Attorney Teresa Smith, who prosecuted the case, Martinez saw the victim, who was ten years old at the time, and followed her into the bedroom where she was going to change her clothes.

“Once she entered the room, she noticed the defendant was behind her, but before she could do anything, he forced her face down onto her bed and sexually assaulted her,” Smith said.

The victim never disclosed the abuse to her parents or to anyone else that night. However, four years after the sexual assault, the victim was in class when one of her teachers disclosed that she too had been a child victim of rape.

“Upon hearing that, the victim suddenly broke down in tears and was taken to her counselor by a teacher’s aide where she finally disclosed the sexual assault,” Smith said.
