DA Finds Non-Fatal Officer-Involved Shooting in Apple Valley Justified

SAN BERNARDINO, Calif.  – The San Bernardino County District Attorney’s Office has completed its review of the non-fatal officer-involved shooting of 42-year-old Dearld Wicker Jr., of Apple Valley involving San Bernardino County Sheriff’s Deputy Scott Abernathy on May 30, 2017.

 

Under the facts, circumstances and law applicable to this case, the use of deadly force by Deputy Scott Abernathy in response to an apparent and immediate threat of death and/or serious bodily injury to him posed by the actions of Dearld Wicker, Jr. was legally justified.
